Can Tourists Buy Cannabis in the East Bay?
Yes. Any adult 21 or older with a valid government-issued photo ID can purchase cannabis at any licensed dispensary in Oakland, Berkeley, or the wider East Bay. Driver's license, passport, state ID, or military ID from any state or country works. There is no residency requirement. California treats visitors exactly the same as residents.

What It Costs: The Tax Situation
There is no single "East Bay tax rate." Every city sets its own local cannabis tax on top of California's 15% excise and ~10.25% sales tax. The total ranges from ~25% to 34% depending on which city you are in. A $35 eighth costs $44–$47+ after taxes.
The city of Alameda charges zero cannabis-specific tax. Total tax at Embarc Alameda is ~25.6% versus ~30–34% in Oakland or Hayward. That saves $4–$8 on every $50 purchase. It's a short drive or bus ride from downtown Oakland.

Payment: Bring Cash
Federal banking restrictions still affect the cannabis industry. Cash is preferred at virtually every East Bay dispensary. Some accept debit cards (with a fee), but credit cards are not accepted. ATMs are available on-site at most locations, typically with $3–$5 fees. Come prepared.
Where to Buy
The East Bay has dispensaries concentrated in Oakland and Berkeley, with additional options across the region:
- Oakland: ~12 storefronts including Harborside (first legal gram in CA), Eco Cannabis (equity-operated), NUG Oakland (first consumption lounge), Cookies Oakland (1776 Broadway)
- Berkeley: Berkeley Patients Group (oldest in America, since 1999), CBCB, 7-storefront cap, sanctuary city since 2002
- Alameda: Embarc (lowest tax in the region)
- Richmond, Hayward, Martinez, El Cerrito: Additional options with varying tax rates
Not every East Bay city allows cannabis retail. Fremont (population 230,000), Walnut Creek, Livermore, and Albany ban dispensaries entirely. Delivery is available statewide under SB 1186 (2024), but you cannot walk into a shop in these cities.
Where to Consume
Public consumption is illegal in California. Your legal options in the East Bay:
- Licensed consumption lounges — Oakland has multiple licensed lounges where you can purchase and consume on-site. NUG Oakland (the city's first), Root'd in the 510 (equity-operated), Urbana, and Happy Lounge. AB 1775 (effective January 2025) now allows lounges to serve food and host events.
- Private property — Your own residence, a friend's home, or cannabis-friendly lodging (confirm directly with the host).
Where You Cannot Consume
- Streets, sidewalks, and parks
- Hotels (most prohibit it — always check first)
- Bars and restaurants (lounges excepted)
- Inside any vehicle, moving or parked
- Federal land and buildings
- BART trains and stations

Oakland has a range of accommodations for cannabis visitors. Rates run from $56 to $250+/night depending on area and season. Downtown Oakland and Jack London Square offer the best access to dispensaries and lounges. Berkeley's University Avenue corridor is another option with easy BART access. Getting Around
BART connects the East Bay to San Francisco and runs through Oakland, Berkeley, Richmond, Fremont, and beyond. Most Oakland dispensaries are within walking distance or a short rideshare from a BART station. AC Transit buses cover Oakland and Berkeley extensively. Rideshare (Uber/Lyft) is widely available. If you are consuming cannabis, do not drive — California treats cannabis DUI with the same severity as alcohol DUI.

East Bay vs. San Francisco
San Francisco is polished, tech-adjacent, and tourist-oriented. The East Bay is rawer, more community-rooted, and more politically charged. SF's cannabis story was shaped by the AIDS crisis and LGBTQ+ activism. Oakland's was shaped by the Black Panthers, the War on Drugs, and the insistence that legalization serve the communities it harmed. Both are worth experiencing, and BART connects them in 12 minutes.
